1. Overview
These Terms of Service ("Terms") govern your use of Makemind Academy (the "Academy", the "Service"), operated by Makemind Ecosystem, Inc., a Delaware corporation (the "Company", "we"). The Academy offers free courses on building with the Makemind platform, certification of what you have learned, and a place where crews of the Makemind Guild offer paid courses and education kits.
By using the Service you agree to these Terms. When you first start using the Academy with your Makemind account, you accept the version of these Terms in force at that moment, and that acceptance is recorded together with the version.
2. Your Makemind Account
2.1 You sign in with your Makemind account. The Academy does not keep passwords of its own.
2.2 The Academy receives your name, email address and profile photo from your Makemind account only after you agree to start using the Academy. Other Makemind services receive nothing because you use the Academy.
2.3 You are responsible for activity under your account. Reading free courses does not require an account.
3. Free Courses and Materials
3.1 Official courses, lessons, videos and samples are free.
3.2 Sample code is published in public repositories under the licence stated in each repository. Running it is at your own risk; check what a sample does before running it on devices or systems that matter.
3.3 Courses may change, be reorganised or be retired. A retired course stays reachable at its address where practical.
4. Certification and Badges
4.1 Each path may end with a certification task. You submit your own work; it is checked by an automatic run of your repository's checks, by a reviewer, or both, as stated on the task.
4.2 A badge records the path and the version of the task you passed, and the date. A badge has a public page that shows your name, the path, the task version and the date.
4.3 If you have a profile in the Makemind Guild under the same verified email address, your badge is shown there and may be cited as evidence in a tier review. A badge is not itself a Guild tier.
4.4 Work that is not your own, or a submission that deceives the check, is grounds to refuse or revoke a badge.
4.5 A later version of a task does not invalidate a badge earned on an earlier one.
5. Crew Courses and Education Kits — Who Sells
Paid offerings are sold in one of two ways. Every offering page and checkout states which one applies.
5.1 Sold by a crew — Your contract is with the crew. You pay the crew's own payment account; the money does not pass through the Academy. The crew is responsible for delivery, support and refunds under the refund policy it publishes. The Academy lists the offering and is not a party to that contract.
5.2 Sold by Makemind Academy — Your contract is with the Company. You pay the Company, which is responsible for the offering, support and refunds under the refund terms shown on the offering. The crew that teaches it does so for the Company.
5.3 Paid offerings build on the free paths. They are not required to understand the platform or to earn a badge.
6. Payments
6.1 Payments are processed by payment providers through the Makemind platform. The Academy does not receive or store card numbers.
6.2 Prices are shown in US dollars and include the amount you will be charged, before any taxes your payment provider or bank adds.
6.3 An order is complete when the payment provider confirms it. A refund or a payment dispute updates the order accordingly.
7. Crews and Instructors
7.1 Courses and kits are published by crews of the Makemind Guild. A crew that publishes accepts the publishing rules shown on the Academy, including that a paid offering goes deeper than a free path rather than filling a gap in it.
7.2 The Academy reviews offerings before they are listed and may decline, send back or withdraw an offering that breaks these Terms or the publishing rules.
7.3 For Academy-sold offerings, the instructor fee agreed for the offering is fixed when it is published and paid to the crew as stated in that agreement.
8. Intellectual Property
8.1 The Company retains all rights in the Service, its courses, text, videos and design, except where a licence says otherwise.
8.2 Crews retain ownership of the offerings they publish and grant the Company a non-exclusive licence to display and promote them on the Service.
8.3 You retain ownership of the work you submit for certification and grant the Company a licence to run, review and keep it for the purpose of certification.
9. Prohibited Conduct
You agree not to:
- submit work that is not your own, or deceive a certification check;
- misrepresent a badge, a certification or your relationship with the Company;
- transmit malicious code or unlawful or harmful content;
- scrape or otherwise misuse the Service;
- circumvent access controls or usage limits;
- infringe the intellectual property rights of others;
- use the Service for any unlawful purpose.
10. Disclaimers
10.1 To the extent permitted by law, the Service and its free materials are provided "as is" and "as available".
10.2 A badge states that a task was passed; it does not warrant anyone's skill for a particular job.
10.3 For offerings sold by a crew, the Company does not warrant the offering and is not responsible for the contract between you and the crew.
11. Limitation of Liability
11.1 To the maximum extent permitted by law, the Company is not liable for indirect, incidental, special, consequential or punitive damages.
11.2 The Company's total liability for all claims in connection with these Terms shall not exceed the amounts you paid to the Company through the Service in the twelve months preceding the claim.
11.3 Nothing in this section limits liability that cannot be excluded by law.
12. Leaving and Suspension
12.1 You may stop using the Academy at any time. Leaving ends the Academy's link to your Makemind account and deletes your Academy profile and progress, except records we must keep by law (for example, orders).
12.2 The Company may suspend an account for a material breach of these Terms or of law. Except where the matter is urgent, we will give you an opportunity to cure first.
12.3 Sections 4.4, 8, 10, 11 and 14 survive, together with any provision that by its nature should survive.
13. Changes to These Terms
13.1 The Company may revise these Terms. A revision is published as a new version with a stated effective date, and a published version is never edited.
13.2 Material changes are announced in the Service at least 30 days in advance, and you may be asked to accept the new version before continuing to use some functions.
14. Governing Law and Disputes
14.1 These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles.
14.2 Disputes in connection with these Terms are subject to the courts of the State of Delaware, United States.
14.3 Nothing in this section limits rights granted to consumers by mandatory law in their country of residence.
15. General
15.1 These Terms, the Privacy Policy and the terms shown on an offering are the entire agreement concerning use of the Service.
15.2 If any provision is held invalid, the remainder continues in effect.
15.3 These Terms are provided in English, Korean, Japanese and Chinese. Where translations differ, the English version controls.
